TPR Apps

Legal

Terms & Conditions

Effective 21 October 2026

These terms apply to every website, app and related service provided by TPR Apps (ABN 55 623 845 262, "we", "us"). When you accept a quote from us, by signing it or by telling us in writing that you want to go ahead, you agree to these terms. If a quote and these terms ever conflict, the quote wins.

1. Quotes and scope

Every project starts with a written quote that sets out what we will build and the fixed price. Quotes are valid for 30 days.

The fixed price covers only what is listed in your quote. If you want something added or changed outside that scope, we will quote it before doing any work, and nothing extra is charged without your written approval.

2. Changes and sign-off

Each project includes two rounds of changes to the design. Extra rounds are quoted before we start.

When we send you a design, a test version or your finished website or app, please tell us within 7 days about anything that doesn't match your quote. If we don't hear from you within 7 days, or you start using it with your customers, that stage counts as approved.

Approval moves the project to the next stage and is when the matching invoice falls due.

3. What we need from you

You agree to give us what we need to do the work, such as your logo, photos, wording, website access and any accounts we ask for, and to give feedback within a reasonable time.

You confirm that you own, or have permission to use, everything you give us, and that it is lawful to publish.

Timelines pause while we are waiting on you. If we hear nothing from you for 30 days, we may close the project and invoice for the work done so far.

4. Timelines

Timelines in quotes are estimates made in good faith. Our 48-hour website timeline starts once we have received all of your content.

App launch dates also depend on Apple and Google review times, which are outside our control.

5. Payment

Websites: no deposit is required. The full price is due once your site is finished and approved.

Apps: nothing is payable until you have seen and approved your design. A 50% deposit is then due before the build starts, and the remaining 50% is due when your app is submitted to Apple and Google for review.

Add-ons and other one-off work are invoiced on completion. Invoices are due within 7 days. Payment plans are available, but only by written agreement before work starts.

If you disagree with part of an invoice, let us know within 7 days. The rest of the invoice is still due on time.

All prices are in Australian dollars. TPR Apps is not registered for GST, so no GST is charged.

If an invoice is overdue, we may pause work, and we keep the code, hosting and accounts we control until it is paid.

6. Third-party costs

Costs charged by other companies are paid by you and are not part of our price unless your quote says otherwise. These include domain names, hosting, the Apple Developer Program, Google Play, and any paid services or plugins your project uses.

We are not responsible for outages, price changes or policy changes made by these companies.

7. Ownership and handover

Once your project is paid in full, you own the custom design, code and content we created specifically for you. We then hand over the code and transfer the hosting and accounts we set up into your name.

Until payment is made in full, ownership of the work stays with us.

We also use our own reusable tools, templates and code across projects. We keep ownership of these, and you get a permanent, free licence to use them as part of your website or app.

Some projects use open-source or third-party tools. These remain under their own licences, which allow you to use them as part of your website or app.

We may show your finished project in our portfolio. Just tell us if you would rather we didn't.

8. App store approval

We build every app to meet Apple and Google guidelines. If review asks for changes to what we built, we will make them at no extra cost until your app is approved.

Apple and Google make the final decision. We can't guarantee approval where the rejection relates to your business, your content or your app idea itself, rather than our work.

9. 30-day bug fixes

For 30 days after launch, we fix any bugs in the work we delivered free of charge.

This does not cover new features, design changes, or problems caused by changes made by you, someone else, or a third-party service.

10. Ongoing changes and care plans

After the 30 days, changes start from $200 AUD depending on the change, and we quote every change before starting.

Care plans are billed monthly in advance and cover hosting or upkeep and small fixes. Larger updates are quoted separately before any work starts.

Either of us can cancel a care plan with 30 days' written notice. If we change a care plan's price or terms, we will give you 30 days' notice, and you can cancel before the change without penalty.

11. Privacy and confidentiality

We keep your business information confidential and only use it to deliver your project.

Our Privacy Policy, on our website, explains how we collect, use and protect personal information.

Your website or app may collect information from your own customers. You are responsible for having a privacy policy and handling that information lawfully, and we can help you set one up.

12. Cancelling a project

You can cancel a project at any time by telling us in writing. You will need to pay for the work completed up to that point, and we will hand over that work once it is paid for.

If we need to cancel, we will refund any payment for work we have not done.

13. Our liability

Nothing in these terms excludes your rights under the Australian Consumer Law.

To the extent the law allows, our liability for any problem with our services is limited to fixing the work or refunding what you paid for it, and we are not liable for indirect losses such as lost profits or lost data.

14. Disputes

If something goes wrong, please talk to us first and we will try to fix it. If we still can't agree, we will try mediation before either of us takes legal action.

These terms are governed by the laws of Queensland, Australia.

15. Changes to these terms

We may update these terms from time to time. The version current when you accept your quote is the one that applies to your project.
